The United Kingdom is a leader in genomics research, and the presence of numerous types of biobanks and the linking of health data and research within the UK evidences the importance of biobank-based research in the UK. There is no biobank-specific law in the UK and research on biobank materials is governed by a confusing set of statutory law, common law, regulations, and guidance documents. Several layers of applicable law, from European to local, further complicate an understanding of privacy protections. (...) Finally, biobanks frequently contain data in addition to the samples; the legal framework in the UK generally differentiates between data and samples and the form of the data affects the applicability of legal provisions. Biobanks must be licensed by the Human Tissue Authority; certain projects must be reviewed by Research Ethics Committees, and all projects are encouraged to be reviewed by them. Data Access Committees in biobanks are also common in the UK. While this confusing array of legal provisions leaves privacy protections in biobanking somewhat unclear, changes at the EU level may contribute to harmonization of approaches to privacy. (shrink)

Whether types are universals is discussed in §3. §4 discusses some other suggestions for what types are, both generally and specifically. Is a type the sets of its tokens? What exactly is a word, a symphony, a species? (...) §5 asks what a token is. §6 considers the relation between types and their tokens. Do the type and all its tokens share the same properties? Must all the tokens be alike in some or all respects? §7 explains some problems for the view that types exist, and some problems for the view that they don't. §8 elucidates a distinction often confused with the type-token distinction, that between a type (or token) and an occurrence of it. Anthropologists have provided rich field descriptions of the norms and conventions governing behavior and interactions in small-scale societies. Here, we add a further dimension to this work by presenting hypothetical moral dilemmas involving harm, to a small-scale, agrarian Mayan population, with the specific goal of exploring the hypothesis that certain moral principles apply universally. We presented Mayan participants with moral dilemmas translated into their native language, Tseltal. Paralleling several studies carried out with educated subjects living in large-scale, developed nations, the (...) Mayan participants judged harms caused as the means to a greater good as more forbidden than harms caused as a side-effect (i.e., side-effect bias). However, unlike these other populations living in large-scale societies, as well as a more educated and less rural Mayan comparison group, the target rural Mayan participants did not judge actions causing harm as worse than omissions (i.e., omission bias). A series of probes targeting the action-omission distinction suggest that the absence of an omission bias among the rural Mayan participants was not due to difficulties comprehending the dilemmas, using the judgment scale, or in attributing a greater causal role for actions over omissions. Thus, while the moral distinction between means and side-effect may be more universal, the moral distinction between actions and omission appears to be open to greater cross-cultural variation. We discuss these results in light of issues concerning the role of biological constraints and cultural variation in moral decision-making, as well as the limitations of such experimental, cross-cultural research. In this volume, Brakel raises questions about conventions in the study of mind in three disciplines—psychoanalysis, philosophy of mind, and experimental philosophy. She illuminates new understandings of the mind through interdisciplinary challenges to views long-accepted. Here she proposes a view of psychoanalysis as a treatment that owes its successes largely to its biological nature—biological in its capacity to best approximate the extinction of problems arising owing to aversive conditioning. She also discusses whether or not "the mental" can have any real (...) ontological standing, arguing that a form of reductive physicalism can be sufficient ontologically, but that epistemological considerations require a branch of non-reductive physicalism. She then notes the positive implications of this view for psychiatry and psychoanalysis, Finally, she investigates the role of "consistency" in method and content, toward which experimental philosophers strive. In essence, Brakel articulates the different sets of challenges pertaining to: a) ancient dilemmas such as the mind/body problem; b) longstanding debates about the nature of therapeutic action in psychoanalysis; and c) new core questions arising in the relatively young discipline of experimental philosophy. My aim in this paper is to explore the limits of a conception of metaphysical explanation based on the Principle of Sufficient Reason (PSR). For this purpose, I will focus on one of the alleged counter-intuitive consequences of an unrestricted application of the PSR, namely: Radical Monism. First, I will articulate such a conception of metaphysical explanation. Then, I will explain how is it that from a famous argument that rests on the PSR (i.e., Bradley’s regress) Radical Monism indeed seems (...) to follow. Right away, I will argue against the natural reaction that such argument triggers, namely: that we shall accept pluralism and relations as brute facts. Finally, I will sketch a qualified version of the PSR that allows us to avoid Radical Monism without compromising the essential content of the PSR. (shrink)

Abstract:This field survey focused on two constructs that have been developed to represent the ethical context in organizations: ethical climate and ethical culture. We first examined issues of convergence and divergence between these constructs through factor analysis and correlational analysis. Results suggested that the two constructs are measuring somewhat different, but strongly related dimensions of the ethical context. We then investigated the relationships between the emergent ethical context factors and an ethics-related attitude (organizational commitment) and behavior (observed unethical conduct) for (...) respondents who work in organizations with and without ethics codes. Regression results indicated that an ethical culture-based dimension was more strongly associated with observed unethical conduct in code organizations while climate-based dimensions were more strongly associated with observed unethical conduct in non-code organizations. Ethical culture and ethical climate-based factors influenced organizational commitment similarly in both types of organizations. Normative implications of the study are discussed, as are implications for future theorizing, research and management practice. (shrink)

I show how the Cosmological Argument (CA) is undermined by one of its own premises: the Principle of Sufficient Reason (PSR). First, I explain the type of CA that I am thinking about. Second, I explain a traditional modal objection against the PSR, which is ultimately based upon our intuitions in favor of contingency. Third, I show how this modal objection begs the question against the necessitarian, and then I reformulate the CA in more neutral terms. Fourth, using this more (...) neutral version of the CA, I argue that the main problem with the PSR goes way beyond its apparent necessitarian consequences. As an argument used by Bradley shows, embracing the rationalist path that underlies the PSR seems to commit us to a form of Radical Monism. I conclude by showing how this result ultimately undermines the CA. (shrink)

Citizenship presents two faces. Within a political community it stands for inclusion and universalism, but to outsiders, citizenship means exclusion. Because these aspects of citizenship appear spatially and jurisdictionally separate, they are usually regarded as complementary. In fact, the inclusionary and exclusionary dimensions of citizenship dramatically collide within the territory of the nation-state, creating multiple contradictions when it comes to the class of people the law calls aliens--transnational migrants with a status short of full citizenship. Knowledge has almost always been treated as good, better than mere true belief, but it is remarkably difficult to explain what it is about knowledge that makes it better. I call this “the value problem.” I have previously argued that most forms of reliabilism cannot handle the value problem. In this article I argue that the value problem is more general than a problem for reliabilism, infecting a host of different theories, including some that are internalist. An additional problem is (...) that not all instances of true belief seem to be good on balance, so even if a given instance of knowing p is better than merely truly believing p, not all instances of knowing will be good enough to explain why knowledge has received so much attention in the history of philosophy. The article aims to answer two questions: What makes knowingp better than merely truly believing p? The answer involves an exploration of the connection between believing and the agency of the knower. Knowing is an act in which the knower gets credit for achieving truth. What makes some instances of knowing good enough to make the investigation of knowledge worthy of so much attention? The answer involves the connection between the good of believing truths of certain kinds and a good life. In the best kinds of knowing, the knower not only gets credit for getting the truth but also gets credit for getting a desirable truth. The kind of value that makes knowledge a fitting object of extensive philosophical inquiry is not independent of moral value and the wider values of a good life. (shrink)

Abstract:This paper outlines three conceptions of the relationship between normative and empirical business ethics, views we refer to asparallel, symbiotic, andintegrative. Parallelism rejects efforts to link normative and empirical inquiry, for both conceptual and practical reasons. The symbiotic position supports a practical relationship in which normative and/or empirical business ethics rely on each other for guidance in setting agenda or in applying the results of their conceptually and methodologically distinct inquiries. Theoretical integration countenances a deeper merging ofprima faciedistinct forms of (...) inquiry, involving alterations or combinations of theory, metatheoretical assumptions, and methodology. According to Ladyman, the world consists of nothing more than relations that relate to no particulars. Could the world be nothing but structure? In this chapter it is argued that even though there are a number of problems with the standard view of relations accompanied by a particularist ontology, substituting for it a world of pure structure is not progress. A world of pure structure would be no more than a Platonic entity, lacking any resources for concretization. Consequently, there would (...) be no possibility of distinguishing between a world-kind and its concrete instance or instances. It is also argued that the view has insufficient empirical motivation. The history of science does not support the claim that structure is preserved through theory change nor that the structural components of a theory are extricable from its ontological commitments. Senior managers are important to the successful management of ethics in organizations. Therefore, their perceptions of organizational ethics are important. In this study, we propose that senior managers are likely to have a more positive perception of organizational ethics than lower level employees do largely because of their managerial role and their corresponding identification with the organization and need to protect the organization’s image as well as their own identity. By contrast, lower level employees are more likely to be cynical (...) about the organization’s ethics. In order to compare senior managers’ and lower level employees’ perceptions of ethics in the organization, we surveyed randomly selected senior managers and lower level employees in three firms. We found that perceptions of ethics in the organization differed predictably across levels, with senior managers’ perceptions being significantly more positive and lower level employees’ perceptions being more negative. Every day, in many situations, we use expressions which seem only vaguely to provide us with information. The weather forecaster tells us that "some showers are likely in Northern regions during the night", a statement which is vague with respect to number of showers, location, and time. Yet such messages are informative, and often it is not possible for the producer of the message to be more precise. A tutor tells his students that "only a few students fail their exams (...) outright". This does not give a precise incidence. Yet it might be equally misleading to do so. For example, to say that 12% failed outright last year says nothing about other years, while to say an average of 8% over the last five years says nothing about variability. We argue that a precise, numerical statement can be sometimes more misleading in reality than a vague statement. Many researchers in psychology have attempted to capture the meaning of quantities by relating them to scales of quantity. The book explores this idea in detail and shows with original studies how these expressions also serve to control attention and to convey information about the expectations held by those involved in the communication. The book works towards a psychological theory of the meaning of quantifiers and similarly vague terms. New links are drawn between formal theories of quantification and psychological experimentation. Sociopaths are “outstanding” members of society in two senses: politically, they draw our attention because of the inordinate amount of crime they commit, and psychologically, they hold our fascination because most ofus cannot fathom the cold, detached way they repeatedly harm and manipulate others. Proximate explanations from behavior genetics, child development, personality theory, learning theory, and social psychology describe a complex interaction of genetic and physiological risk factors with demographic and micro environmental variables that predispose a portion of the population (...) to chronic antisocial behavior. More recent, evolutionary and game theoretic models have tried to present an ultimate explanation of sociopathy as the expression of a frequency-dependent life strategy which is selected, in dynamic equilibrium, in response to certain varying environmental circumstances. This paper tries to integrate the proximate, developmental models with the ultimate, evolutionary ones, suggesting that two developmentally different etiologies of sociopathy emerge from two different evolutionary mechanisms. Social strategies for minimizing the incidence of sociopathic behavior in modern society should consider the two different etiologies and the factors that contribute to them. (shrink)

Disaster response is a highly collaborative and critical process that requires the involvement of multiple emergency responders (ERs), ideally working together under a unified command, to enable a rapid and effective operational response. Following the 9/11 and 11/13 terrorist attacks and the devastation of hurricanes Katrina and Rita, it is apparent that inadequate communication and a lack of interoperability among the ERs engaged on-site can adversely affect disaster response efforts. Within this context, we present a scenario-based terrorism case study to (...) highlight the challenges of operational disaster command and response. In this article, which is based on the French emergency response doctrine, we outline a semantics-based common operational command system that is designed to guarantee an efficient information flow among ERs. Our focus is on offering to all ERs, a real-time operational picture of the situation in order to enable multilevel coordination among firefighters, police, healthcare units, public authorities, and other stakeholders. Our approach consolidates information to promote timely sharing of data among ERs. The proposed system is based on an ontology that has been developed to represent the different types of knowledge on the part of ERs, providing a shared vocabulary that covers a variety of interoperability concerns. A couple of decades ago natural phenomena began to be approached from a comprehensive and transdisciplinary point of view, as it was understood that living beings and their environments are not linear but complex. There is no doubt that this perspective of visualizing complexity and working inter-and transdisciplinarily has to be applied. The reflection on the theoretical observation (i.e. meta-observation) involved in the concept of poly-contexturality is the framework in which a theory of complex systems is possible, which in turn (...) enables an observation that oscillates (a concept of chaos theory) between modelsstructured in a hierarchical order (normally linked to a logical-deductive formalization) and models structured in hetero‐hierarchy. And this would allow this reflection to be done in a formalized language that does not follow either the principles of the Aristotelian logic or the postulates of the Kantian transcendental reflection. It is precisely this liberation from the dictates of mono-contextural logic what paves the way to an observation of complexity, in which one or the other language is used to model the states of things, such as the epistemological problems of molecular biology or the social systems. And-what is gaining relevance-it also paves the way to a true transdisciplinary meta-observation, since each discipline chooses its own contexture and only the use of poly-contexturality makesit possible to formulate transdisciplinary relationships within the framework of such meta-logic. Foucault plantea que no hay una sola racionalidad desde la que sean pensables todas las dimensiones de la actual complejidad, por el contrario, la comprensión del presente abre el espacio al análisis histórico de las instituciones sociales y de sus procesos, por medio de dispositivos teórico-metodológicos desarrollados por el enfoque divergente del autor, que amplía la reflexión de los procesos de construcción, reconstrucción y modificación de las representaciones y las identidades sociales. Uno de los ejes de análisis es el sentido (...) común, por ello surge la pregunta ¿cómo el sentido común ordena la palabra? y ¿qué hay de amenazante en las palabras de las personas? Aunado, el análisis del discurso saca a la luz el juego de su poder de afirmación de dominios de objetos. Otro eje es el poder, instrumento conceptual para entender, pensar y ordenar el mundo social, a los sujetos y a sus prácticas sociales y culturales. Poder, productor de conocimiento y realidad, que determina las vías por las cuales se construyen las verdades aceptadas en una época determinada. Foucault lo propone como un poder productor, creador de un régimen de verdad que desarrolla un pensamiento sistematizador y racional, lo mismo que creador de subjetividades. (shrink)
